1. Agreement to Terms

By accessing or using CodevOps's services, including web development, app development, digital marketing, and AI automation services, you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Services Description

CodevOps provides the following services:

• Web Development (custom websites, e-commerce solutions, web applications)
• App Development (iOS, Android, and cross-platform applications)
• Digital Marketing (SEO, SEM, social media marketing, content marketing)
• AI Automation (chatbots, process automation, AI integration)

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information when requested
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Use our services only for lawful purposes
• Not interfere with or disrupt the service or servers

4. Intellectual Property Rights

All content, features, and functionality available through our services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of CodevOps or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Upon full payment for services, clients receive ownership of the final deliverables as specified in the project agreement, while CodevOps retains rights to underlying technologies, frameworks, and tools used in development.

5. Payments and Billing

Our services are provided according to the following payment terms:

• Projects typically require an initial deposit before work begins
• Payment schedules will be outlined in project proposals
• All fees are exclusive of taxes, which will be added to invoices where applicable
• Late payments may result in project suspension or termination

6. Project Timelines and Delays

We strive to meet all project deadlines as specified in project proposals. However:

• Timelines are estimates and not guaranteed deadlines
• Client delays in providing necessary materials or feedback may impact project timelines
• We are not liable for delays caused by circumstances beyond our reasonable control

7. Revisions and Change Requests

Our services include:

• A specified number of revision rounds as outlined in project proposals
• Additional revisions available at standard hourly rates
• Change requests that significantly alter project scope may require additional fees

8. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information received during the term of service. This obligation will survive termination of our relationship.

9. Third-Party Services

Our services may integrate with or require third-party services (hosting providers, APIs, etc.). We are not responsible for the performance, terms, or policies of these third-party services.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that our services will be uninterrupted, timely, secure, or error-free.

11. Limitation of Liability

In no event shall CodevOps, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any unauthorized access to or use of our servers and/or any personal information stored therein

12. Indemnification

You agree to defend, indemnify, and hold harmless CodevOps and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses resulting from or arising out of your use of and access to the service, or your violation of these Terms of Service.

13. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will immediately cease.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms.
